Please read these conditions carefully before using the Bothy Threads Ltd website. By using this website, you signify your agreement to be bound by these conditions.

Definitions
Customers or visitors to this web site are referred to as “you”.

Bothy Threads Ltd are referred to as “us” or “we”.

1. Security & Order Confirmation

Security – Payment Details

We DO NOT store Credit or Debit Card details. This means that nobody can steal your details as we simply do not have them!

We use Stripe as our payment processing partner who use the most secure up to date encrypted SSL (secure socket layer) when transferring transaction details in the checkout process. This means that no information submitted during this process can be examined, used or modified by any unauthorised third parties. Our customers credit card information never hits our servers, it goes from our customers computer/device straight to Stripes servers keeping their information safe.

Our Customers can also Save their Credit & Debit Cards details for faster payment of any future orders, but for security we DO NOT store these Credit or Debit Card details, instead these details are saved on Stripes servers for added security.

You can pay by most major credit and debit cards. Your details will be encrypted to keep them secure.

Security – Customer Personal Details

Our website utilises industry-standard Secure Sockets Layer (SSL) technology to allow for the encryption of potentially sensitive information such as your name, address and other critically sensitive information. Information passed between your computer and our website cannot be read in the event someone else intercepts it.

This technology includes the following features:

  • Authentication – this assures your browser that your data is being sent to the correct computer server, and that the server is secure.
  • Encryption – this encodes the data, so that it cannot be read by anyone other than the secure server.
  • Data Integrity – this checks the data being transferred to ensure it has not been altered.

When you access a website secured by an SSL certificate issued by a trusted Certificate Authority, you will see https:// at the beginning of its URL. Depending on the type of validation a certificate applicant passed prior to the certificate issuance, a browser may also show the connection as secure by displaying a “lock” icon in the address bar.

Order Confirmation

You can pay by most major credit and debit cards. Your details will be encrypted to keep them secure. Once your card details have been processed by Stripe, you will be able to view an onscreen confirmation that your order process is completed and you will also receive an email invoice confirming your order. Additionally, you will also be able to login to your ‘Bothy Threads Ltd’ account to view and check the status of your order.

When you place an order to purchase a product you will receive an automatic e-mail confirming receipt of your order and containing the details of your order, including transaction and order reference numbers. Your order represents an offer to us to purchase a product, which is accepted by us when we process payment for your order.

When we accept your order, we will send a Dispatch Confirmation E-mail.

Any products on the same order which we have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract.

If you have incorrectly entered your email address your confirmation and dispatch email will fail. So long as payment has been processed successfully this will in no way affect your order.

Failure by us to send a receipt confirmation email or dispatch confirmation email in no way invalidates your offer or our acceptance of your offer.

3. Damage & Tracing Parcels

In the event that your goods are damaged in transit, please contact us within 24 hours of receipt. If you fail to do this, or if goods have been signed for as received in good condition, we may not be able to offer a refund.

If products are not delivered please contact us for details of the tracking and tracing procedure.

If orders are considered by us to be lost in transit after a reasonable period of time has elapsed, we shall at our discretion either refund or resend the order.

When ordering goods from us for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be.

If a package arrives in a damaged condition, do not open it, but immediately ask the delivery firm to return the package, and please inform us immediately.

5. Prices & Product Details

By default all prices quoted are in £ Sterling (GBP). Please use the currency changer at the top of the website to view product prices in an alternate currency.

Please note that Currency conversions are estimated and should be used for informational purposes only.

We endeavour to ensure that the information shown on the website is as accurate as possible.

We cannot be held responsible for typographical errors on this site, including but not limited to those regarding price. We reserve the right to make changes to our web site including prices, products and terms & conditions without any notice being given.

If you re placing an order from outside of the UK, VAT will be deducted from your order at the checkout. There may be import tax and duties to pay locally before you receive your parcel, which are the full responsibility of the recipient to pay. These rates are set by the government/postal service in your delivery country.

All products and services are subject to availability and may be withdrawn from sale at any time.

6. Cookies

The title for goods supplied remains with us until full payment has been received.

9. Privacy Pledge

We take your privacy very seriously and are committed to providing users with an Internet experience that respects your privacy.

When you make a purchase we need to collect certain information to process your transaction and fulfil your order. We do not sell, rent or disseminate this information to any third party for marketing or any other purposes.

We will not disclose your details to anybody unless required by law to do so or unless you explicitly give us authority to do so.

10. Spam Attack

The EU Directive on Privacy and Electronic Communications demands that member states do more to combat spam. The UK law tries to create a system that lets legitimate businesses send direct e-mail to users but attempts to stop the scammers and spammers.

We only send emails to addresses that have been supplied directly to us by customers and we always remove addresses from our address book when requested to do so by those customers.

We never spam.

11. Data Security

We endeavour to take all reasonable steps to protect your personal information. All the data collected by us is stored on a secure server. The secure server software encrypts all information you input before it is sent to us.

12. Data Protection Act 1998

We are not required to register under the Act, however we are required to follow eight guiding principles laid down by the Act. These are:

Fairly and lawfully processed;

Processed for limited purposes;

Adequate, relevant and not excessive;

Accurate and up-to-date;

Not kept for longer than is necessary;

Processed in line with the data subject’s rights;

Secure; and

Not transferred to a country outside the European Economic Area (EEA), unless that country ensures the protection of the rights of the individual to whom the data relate.

13. Your Account

If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account.

You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

14. Access to Our Website

This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.

You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the home page of our web site as long as the link does not portray us, our products or services in a false, misleading, derogatory, or otherwise offensive matter.

15. Your Conduct

You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. You must use the website for lawful purposes only and must not use the website for any of the following:

Fraudulent purposes, or in connection with a criminal offence or other unlawful activity;

To send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing;

In breach of copyright, trademark, confidence, privacy or any other right;

Is otherwise injurious to third parties;

Objectionable;

Which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any “spam”; or any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

Causes annoyance, inconvenience or needless anxiety.

16. Copyright

All content included on the website, such as text, graphics, logos, button icons, and images belong to us, or our suppliers, and are protected by United Kingdom and international copyright laws.

17. Trademarks

Our graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of Bothy Threads Ltd, and may not be used in connection with any product or service without our written authorisation.

18. Events Beyond Our Reasonable Control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

19. Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed.

Your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

20. Licence for Website Access

We grant you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent from us.

This licence does not include any resale or commercial use of this website or its contents.

21. Governing Law and Jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales.

22. Statutory Rights

These conditions in no way affect your statutory rights.

23. Bothy Bonus Points

Bothy Bonus Points earned for product purchases are awarded when a retail order is completed. Wholesale orders can not collect or redeem Bothy Bonus Points.

Points are also awarded when an order transitions from the “failed” state to either processing or completed to account for payment processing errors that can be corrected, such as a declined card.

Points being redeemed for a discount on purchase will be deducted from a customer’s balance immediately upon checkout. If the order is then cancelled or refunded the redeemed points are automatically credited back to the customer’s account.

If an order that earned a customer points is cancelled or refunded, any awarded points are automatically deducted from that customer’s balance.

Points are awarded at a rate of 10 points for every £1.00 spent. Points can be redeemed as 100 points for every £1.00 deduction. 500 points are awarded for a new account signup.

Bothy Bonus Points cannot be used in conjunction with any other discounts including when a product is already on sale.

24. Competition and Giveaway Rules

Official Giveaway Rules

No purchase or payment of any kind is necessary to enter or win.

Sponsor

All contests and giveaways are sponsored by Bothy Threads limited. (“sponsor”). References to sponsor in this agreement shall refer solely to the company sponsoring the contest and, its parent company, affiliates, subsidiaries, and respective employees, officers, and directors.

All local laws and regulations apply. Void where prohibited. Participation in the giveaway constitutes your agreement to and acceptance of the official rules (“rules”) below.

24.1 - Eligibility

This giveaway (the “giveaway”) is open to those that sign up on the official giveaway site: www.bothythreads.com and those who are legal residents of giveaway entry age in the United Kingdom only.

Employees of sponsor and other companies associated with the promotion of the giveaway, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The giveaway is subject to all local laws and regulations.

24.2 - Agreement to rules.

Participation in the giveaway constitutes your agreement to and acceptance of these rules and the decisions of the sponsor, which are final and binding. Winning a reward is contingent upon being and staying compliant with these rules.

24.3 - Giveaway period

The giveaway begins and ends on the days specified in the giveaway description on the Bothy Threads Competition Page (the “giveaway period”). Entries that are submitted before or after the giveaway period will be disqualified.

24.4 - How to enter

The giveaway must be entered by submitting an entry on the official giveaway site www.bothythreads.com/competitions during the giveaway period. The entry must fulfil all giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or submitted without following the rules or specifications may be disqualified at the sole discretion of the sponsor.

You may enter only once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your entry may be removed from eligibility at the sole discretion of the sponsor.

24.5 - Winner notification

This section is only applicable to eligible entrants that qualify for a reward and have not been disqualified for attempting to circumvent the rules as determined by the sponsor.

The sponsor will attempt to notify the potential winner(s) via email on or about the end of the giveaway period. If you are eligible for a prize or reward, you will be notified by email. You will be required to respond to us within fifteen (15) days of the date of notice or attempted notice is sent, in order to claim your reward. If you cannot be contacted, or you fail to respond appropriately within the required time period, or the reward is returned as undeliverable, you may forfeit your reward.

Any violation of these official giveaway rules by any winner (at sponsor's sole discretion) will result in the winner's disqualification as winner of the sweepstakes and will no longer be considered an eligible participant.

24.6 - Odds of winning

The odds of winning depend on the total number of entries received.

24.7 - General conditions

In the event that the operation, security, or administration of the giveaway is impaired in any way for any reason, including, but not limited to fraud, technical problems, security malfunctions, or in the event the giveaway is unable to run as planned for any other reason as determined by the sponsor in its sole discretion, the sponsor may, in its sole discretion, either: (1) suspend the giveaway to address the impairment and then resume in a manner that best conforms to the spirit of these rules; or (2) terminate the giveaway and, in the event of termination, no participant shall be eligible for a reward of any type.

The sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the giveaway or to be acting in violation of these rules or in a disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the giveaway including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computing device in excess of that allowed by sweepstakes rules; or the use of bots, employed humans to create false entries, macros or scripts or other technical means for entering may be a violation of criminal and civil law, and, should such an attempt be made, the sponsor reserves the right to seek damages (including Lawyer fees) and any other remedies from any such person to the fullest extent permitted by law.

24.8 - Release and limitations of liability

By participating in the giveaway, you agree to release and hold harmless the sponsor, and each of its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the giveaway, and each of their respective officers, directors, employees, shareholders, representatives, and agents (together, “released parties”) from and against any claim or cause of action arising out of participation in the giveaway or receipt of a reward, including, but not limited to: (a) any technical errors associated with the giveaway, including lost, interrupted or unavailable internet service provider (ISP), network, server, or wireless service provider; (b) unauthorized human intervention in the giveaway; (c) mechanical human, printing or typographical errors; or (d) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the giveaway or acceptance, receipt or misuse of any reward you may receive.

You further agree that in any cause of action, the released parties' liability will be limited to the cost of entering and participating in the giveaway, and in no event shall the entrant be entitled to receive lawyer’s fees. Released parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the giveaway.

24.9 - Privacy & information submitted

Any information you provide to the sponsor may be used to communicate with you in relation to this giveaway or on a giveaway winners’ list. By ticking the join mailing list box, you agree to receive email newsletters periodically from the sponsor. You can opt-out of receiving these emails at any time by clicking the unsubscribe link in the newsletter. Information submitted in connection with the giveaway will be treated in accordance with the sponsor’s privacy policy.

24.10 - Arbitration

These rules shall be governed by, and construed in accordance with, the laws of the United Kingdom, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the sponsor location.

Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the giveaway or any reward awarded shall be resolved by binding arbitration, without resort to any form of class action, and exclusively by the appropriate court located in the giveaway home location. The parties agree to follow the arbitration procedures set forth by the UK Chartered Institute of Arbitrators (CIArb) to resolve the dispute. Arbitration proceedings shall take place in the giveaway home location. Each party is responsible for paying its own filing, administrative and arbitrator fees. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.
